In New York State, every alleged case of child abuse or neglect is investigated.  If you are contacted by your county’s Department of Social Services or New York City’s Administration for Children Services, you should immediately contact an attorney.

If you are charged with neglect, you may be accused of failing to properly care for your children by providing them with inadequate education or medical care, or that you have abandoned your children, or have failed to exercise a minimum degree of care for the child.  If you are charged with abuse, you can be accused of physically, sexually, mentally or emotionally harming the children.

If evidence of child neglect or abuse is found, your local child protective agency may seek to remove your children from your care in circumstances of alleged imminent danger to the children.  If your local Department of Social Services removes your children, you are entitled to be heard in court the next date the court is open.  It is important to consult with an experienced attorney who can prepare you and your case for court on short notice.
